23 April 2014

Dear Sirs,

Commercial Information Circular No. 361/2014

US : Non-Application of Withdrawn Targeted Dumping Regulations in Antidumping Duty Investigations

The United States Department of Commerce (DoC) issued a notice in the Federal Register (FR) of 22 April 2014 a final rule to continue not to apply previously withdrawn targeted dumping regulations in less-than-fair-value investigations. The FR notice is available at: http://www.gpo.gov/fdsys/pkg/FR-2014-04-22/pdf/2014-08186.pdf.

DETAILS

2.Following a decision of the Court of International Trade in 2013, DoC commenced the subject rulemaking process. The final rule now determines that it will continue to not apply regulatory provisions withdrawn in December 2008 governing targeted dumping in antidumping duty investigations. Instead, DoC will continue to determine whether to apply an alternative comparison method as appropriate based upon the particular facts in each case.

3.The final rule is effective 22 May 2014 and will apply to all less-than-fair-value investigations initiated on or after 22 May 2014.
