Commercial Information Circular No. 232/2014

Chile : Ex-post Preference Claims under Free Trade Agreement

Pursuant to Commercial Information Circular No. 118/2014 of 7 February 2014 stating that the cerification of origin number is not required for ex-post preference claims, the Chilean Customs issued Exempt Resolution No. 14229/2013 on 30 December 2013 to establish certain requirements for making ex-post preference claims under a free trade agreement.

2.Modifications to the customs document ("solicitud de modificación a documento aduanero"/SMDA in Spanish) must be submitted electronically if an importer wishes to modify the import regime from "general" to "preferential" treatment, unless the goods are covered by a tariff-rate quota. SMDAs must be processed and accepted prior to the filing of a duty refund request.

3.Any duty refund requests must comply with the instructions set forth under point 2.7 of Chapter IV of the Payment Manual. Such requests must be submitted with (i) a copy of the receipt or voucher showing the payment of duties; (ii) a copy of the declaration of entry for general regime; (iii) a copy of the approved SMDA modifying the importation regime from "general" to "preferential" treatment; (iv) a copy of the origin document showing that the goods comply with all applicable origin requirements; and (v) a document, whenever applicable, showing that goods transhipped through a third country remained under customs custody in that country. The duty refund requests will be processed within 10 working days from the date of filing.
