Commercial Information Circular No. 206/2014

Brazil : Regulations Regarding Legal Representative Requirements in Trade Remedy Proceedings

Pursuant to Commercial Information Circulars No. 835/2013 of 21 October 2013, No. 1009/2013 of 16 December 2013 and No. 37/2014 of 7 January 2014 regarding the administrative procedures on investigation and application of anti-dumping (AD) measures and other aspects of AD investigations, the Ministry of Development, Industry and Foreign Trade (MDIC) of Brazil issued Decree No. 2/2014 on 23 January 2014 regarding legal representive requirements in trade remedy proceedings.

2.Request for participation of foreign interested parties (except governments) in trade remedy proceedings must be submitted to the Secretariat of Foreign Trade ("Secretaria de Comércio Exterior"/SECEX in Portuguese) within 20 days from the date of publication of the Circular announcing the initiation of the investigation. The legal representative may be undertaken by the director, president, manager or any employee of the foreign interested party if they are properly appointed. Details are at Article 5 of Decree No. 2/2014.
