Commercial Information Circular No. 1014/2014

Brazil : Conformity Certification Requirements for Certain Automotive Components, Toys and Child Safety Seats

The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decrees No. 455/2014, No. 459/2014 and 466/2014 on 7 October 2014, 10 October 2014 and 16 October 2014 respectively to establish or modify the conformity certification requirements for (a) certain automotive components; (b) certain toys; and (c) certain child safety seats.

(a) Certain Automotive Components

Further to Commercial Information Circular No. 509/2011 of 24 August 2011 regarding the establishment of conformity certification requirements for automotive components, the INMETRO issued Decree No. 455/2014 to amend the requirements which, among other, allow the use of "System 7" (in addition to "System 5") to certify certain automotive components provided that certain conditions are met.

(b) Certain Toys

The INMETRO issued Decree No. 459/2014 to set the maximum permissible optical power for laser radiation sources used in toys at 1 mW.  Compliance with the requirement must be verified during the conformity certification process.  Manufacture, import or sale will be banned if the requirements are not met, and subject to immediate recall.

(c) Certain Child Safety Seats

The INMETRO issued Decree No. 466/2014 to modify the conformity certification requirements for child safety seats used in motor vehicles.  The compliance dates of the requirements are:

 Compliance Date Application Criteria
(i) 17 April 2016 manufacture and import of such products
(ii) 17 October 2016 domestic sale of such products by manufacturers and importers
(iii) 17 October 2017 domestic sale of such products by all other parties
