US : FDA's Final Rule on Criteria Used to Order Administrative Detention of Food for Human or Animal Consumption
The US Food and Drug Administration (FDA) issued in the Federal Register (FR) of 5 February 2013 a final rule concerning detention of food for human or animal consumption. Relevant FR notice is available at: http://www.gpo.gov/fdsys/pkg/FR-2013-02-05/pdf/2013-02497.pdf.
DETAILS
2.The trade was informed via Commercial Information Circular No. 266/2011 of 6 May 2011 the FDA's interim final rule to change the criteria for ordering administrative detention of human or animal food as required by the FDA Food Safety Modernization Act. The FDA is issuing this final rule to adopt without change the interim final rule. Under the new criteria, the FDA can order an administrative detention if there is reason to believe that an article of food is adulterated or misbranded.
3.The final rule is effective on 5 February 2013.
