US : Withdrawal of the Proposal to Eliminate the First Sale Rule in Customs Valuation
The US Customs and Border Protection (CBP) issued in the Federal Register (FR) of 29 September 2010 a notice to withdraw a 2008 proposal to eliminate the first sale rule. The FR notice is available at: http://edocket.access.gpo.gov/2010/pdf/2010-24464.pdf.

The trade was informed via Commercial Information Circular No. 81/2008 of 28 January 2008 of the CBP's proposal on a new interpretation of the phrase "sold for exportation to the United States" for the purposes of applying the transaction value method of valuation in a series of sales importation scenario. Under this proposed interpretation, the price actually paid or payable for the imported goods when sold for exportation to the US would be the price paid in the last sale occurring prior to the introduction of the goods into the US, instead of the first (or earlier) sale. The CBP now formally withdraws this proposal.
