Dear Sirs,

Commercial Information Circular No. 210/2009

Canada : Regulations on Labelling Textile Articles Derived from Bamboo

The Canadian Competition Bureau (CB) announced in a notice of 11 March 2009 that it is taking steps to ensure that textile dealers comply with the Canadian Textile Labelling Act (TLA) and its regulations as they apply to fabric labelled "bamboo". Interested parties may refer to the attached Annex (pdf format) or the website of the CB at
http://www.competitionbureau.gc.ca/eic/site/cb-bc.nsf/eng/03022.html for details.

  1. Until 31 August 2009, textile dealers will be permitted to sell existing stocks of textile articles that were in production, manufactured, labelled or packaged, in the ordinary course of business, prior to 11 March 2009. After 31 August 2009, the CB will conduct marketplace surveillance to ensure compliance with the TLA. Full text of the TLA is available on the website of the Canadian Department of Justice (DoJ) at:
    http://laws.justice.gc.ca/en/ShowFullDoc/cs/T-10///en.

  2. An increase in claims of textiles being "bamboo", "made from bamboo" or containing "bamboo fibres" has prompted the CB to reaffirm its position that, whenever an article is made of man-made rayon fibres derived from bamboo, the generic fibre name must first make reference to "rayon" or the corresponding chemical process outlined in the Textile Labelling and Advertising Regulations (TLAR) and can be followed by the words "from bamboo". Details of the TLAR is available on the website of the DoJ at:
    http://laws.justice.gc.ca/en/showtdm/cr/C.R.C.-c.1551//?showtoc=&instrumentnumber
    =C.R.C.-c.1551.

  3. In addition, the CB has published a document entitled "Guidance on Labelling Textile Articles Derived from Bamboo" to assist textile dealers with compliance. The document is available on the website of the CB at:
    http://www.competitionbureau.gc.ca/eic/site/cb-bc.nsf/eng/03021.html.

  4. Traders are strongly advised to seek clarifications with their importers in Canada in order to comply with the necessary requirements.
