Mexico : Final Rule on Labelling Requirements for Toys

The Mexican Government published in the Official Gazette of 17 April 2008 a final rule on the labelling requirements for all toys sold in Mexico. The final rule will take effect nine months after its publication in the Official Gazette.

2. Commercial Information Circular No. 120/2007 dated 13 March 2007 reported on the Mexican Government's proposed rule on labelling requirements for toys. Having received public comments on the proposed rule, the Mexican Government issued the final rule on 17 April 2008. The labelling requirements will apply to toys made from any materials, including those operated with cells, batteries or any other power source, but would not apply to firearm replicas. While the compulsory commercial information required by the final rule to be included in the labels is basically the same as those specified in the proposed rule, several amendments have been made to the requirements on warnings on toys and specific labelling requirements for certain toys. In particular, the final rule clarifies that warning labels relating to small products or parts contained in the toy are required when the toy is intended for children under five years of age. Toys intended for children three years of age and younger must not contain small parts.

3. Specifications of the labels are detailed in the Official Gazette notice. For more information of the rule, traders are strongly recommended to seek clarifications with their importers in Mexico in order to comply with the necessary requirements.
