Argentina : New Origin Verification Procedures

The Argentine Government has recently announced new procedures for verifying origin of imported goods. The new measure has been effective since 29 June 2007.

DETAILS

  1. For import of goods subject to specific import measures (e.g. antidumping duties, safeguard measures, compensatory duties, etc), the Argentine Government has all along required the presentation of a certificate of origin. Given the concern that the origin criteria used in the foreign country where a certificate of origin is issued may not fully correspond with Argentine origin requirements and that the goods may be transhipped through third countries together with false country of origin declarations in an attempt to circumvent the specific import measures, the Ministry of Economy and Production of Argentina has introduced since 29 June 2007 some new procedures to verify the origin of imported goods.
     

  2. Where the accuracy of the certificate of origin or the origin of the imported goods is in doubt, the Ministry of Economy and Production of Argentina may decide to start the origin verification process. The importer concerned would be required to present, within 45 days after receiving the notification, information in accordance with the "Origin Verification Questionnaire". The questionnaire must be signed and dated by the exporter or manufacturer of the goods or the supplier of the materials used in the production of the goods and countersigned by the Argentine consulate in the declared country of origin. Essential information required in the questionnaire includes, for example :

  • information of the manufacturer; 
     

  • information of the goods and its tariff classification;
     

  • description of originating materials, non-originating materials and materials of unknown origin, together with the name and address of the suppliers; and
     

  • description of the production process of the finished goods, including the place where each stage of production is carried out and the order of production.

The questionnaire must also be accompanied by supplementary documents such as copy of commercial documentation showing the purchase of raw materials and components used in the production of the finished goods; commercial catalogue; export and production statistics etc.

  1. During the process of origin verification, the Argentine Customs would require a guarantee for the shipment concerned. The guarantee will be returned upon verification of the authenticity of the origin information. 
     

  2. To clarify the relevance of the new requirements to their exports to Argentina and/or to obtain further information on the detailed requirements, traders are advised to consult their importers in Argentina.
