(Arrangements for Making Requests in the Second Round of Consultation in 2023)

Introduction

Further to Certificate of Origin No. 7/2022 of 5 December 2022, this circular reminds the trade about the deadline for making requests in the second round of consultation in 2023 for revisions to CEPA Rules of Origin (ROOs) under the Agreement on Trade in Goods (the Agreement) of the Mainland and Hong Kong Closer Economic Partnership Arrangement (CEPA).

Details

2.According to the Agreement, a good will qualify as an originating good if it meets the corresponding ROOs as well as other applicable provisions1. If manufacturers need to request for revisions to CEPA ROOs due to improvement in production technology or other reasons, they can submit their proposed revisions with the relevant information to Trade and Industry Department (TID). The Working Group on Rules of Origin established under the Agreement will conduct consultations on the proposed revisions to ROO in accordance with the agreed mechanism and time frame.

3.According to the time frame of the CEPA ROO Consultations agreed by the Mainland and Hong Kong, the Working Group on Rules of Origin will conduct two rounds of ROO Consultations in respect of the revisions proposed by Hong Kong manufacturers in 2023. Applications received from 16 January 2023 to 15 July 2023 will be included in the second round of consultation in 2023. Applications received after 15 July 2023 will be included in the next phase of consultations (in 2024).

4.Details of the implementation procedures of the ROO Consultations and the application procedures are set out in Certificate of Origin Circular No. 7/2022. Hong Kong manufactures who wish to request for revisions to CEPA ROOs may refer to the circular and provide information of the relevant goods and production details to TID by completing the application form attached to the circular.
