New Zealand : Monetary Screening Threshold Applicable to Investors from Hong Kong

This Circular informs traders of the updated monetary screening threshold applicable to Hong Kong investors in relation to the Hong Kong, China - New Zealand Closer Economic Partnership Agreement (CEP).

DETAILS

2.The monetary screening threshold for Hong Kong investors that are service suppliers is NZ$20 million as originally set out in II-NZ-I of New Zealand's Schedule to Annex II of Chapter 13 (Trade in Services) of the CEP. With the amendment of New Zealand's Overseas Investment Act 2005 and its subsidiary regulations in 2018 (details of the regulations are available at https://www.legislation.govt.nz/regulation/public/2018/0224/17.0/LMS119682.html (English only)), the monetary screening threshold for investments in significant business assets has been increased to NZ$200 million for non-government investors, which has also been extended to Hong Kong investors that are service suppliers investing in a commercial presence pursuant to Article 12 (Most Favoured Nation Treatment) of Chapter 13 (Trade in Services) of the CEP.
