Cambodia : The European Commission's Decision to Partially Withdraw Tariff Preferences provided to Cambodia

Further to Commercial Information Circular No. 829/2019 dated 14 November 2019, this Circular informs traders that the European Commission ("Commission") has decided to temporarily withdraw part of the tariff preferences provided to Cambodia under the Everything But Arms ("EBA") trade scheme as the Commission has concluded that Cambodia has serious and systematic violations of the human rights principles enshrined in the International Covenant on Civil and Political Rights (1966). The temporary withdrawal of partial tariff preferences will affect certain garment and footwear products, travel goods and sugar.

2.Salient points of the Commission's decision are set out in table below:

Product Coverage Products originating in Cambodia under the following Harmonized System ("HS") codes:

1212 93, 4201 00, 4202, 4203, 4205 00, 4206 00, 6103 41, 6103 43, 6103 49, 6105, 6107, 6109, 6115 10, 6115 21, 6115 22, 6115 29, 6115 95, 6115 96, 6115 99, 6203 41, 6203 43, 6203 49, 6205, 6207, 6211 32, 6211 33, 6211 39, 6211 42, 6211 43, 6211 49, 6212, 6403 19, 6403 20, 6403 40, 6403 51, 6403 59, 6403 91, 6403 99, 6405 and 6406.
Tariff Rate of the Product Tariff preferences for the covered products imported into European Union ("EU") will be withdrawn. Standard tariffs (i.e. most favoured nation (MFN) import tariffs) will be applied. Traders may check the respective tariff rates of the products concerned at the Commission's webpage (https://madb.europa.eu/madb/euTariffs.htm) by referring to the category of "third country duty".
Date of entry into force The decision to temporarily withdraw partial tariff preferences will come into effect on 12 August 2020 (Wednesday).

3.The Commission will continue to monitor the human rights situation in Cambodia and may reinstate the respective tariff preferences under the EBA trade scheme when the situation of human rights violations in Cambodia improve.
