US : Elimination of Textile Declaration Requirement

The US Bureau of Customs and Border Protection (CBP) has issued an interim rule, titled "Country of Origin of Textile and Apparel Products" in a Federal Register (FR) notice dated 5 October 2005 (Annex (pdf format)), to update, restructure and consolidate the regulations relating to the country of origin of textiles and clothing (T & C) products so as to reflect the elimination of T & C quotas among World Trade Organization members as of 1 January 2005. Amongst all the changes and amendments introduced by the rule, the ones that are of substantive impact to the trade include (i) the elimination of the textile declaration requirement; and (ii) the imposition of the manufacturer identification code (MID) requirement.

  1. Starting from 5 October 2005, CBP will no longer require textile declaration be submitted for imports of T & C products from all countries and places. However, T & C importers must identify the manufacturers on all relevant Customs documents, i.e. CBP Form 3461 (Entry/Immediate Delivery) and CBP Form 7501 (Entry Summary), and in all relevant electronic data transmissions by means of an MID. The MID is constructed from the name and address of the entity performing the origin-conferring operations. For information on how the MID is created and used, please refer to "Appendix To Part 102 - Textile and Apparel Manufacturer Identification" of the FR notice. If MID is not found in Customs documents for an import shipment, the merchandise concerned may be denied entry or be subject to other appropriate action.
     
  2. As stated in the FR notice, comments on the interim rule can be addressed to CBP on or before 5 December 2005.
