TRADE AND INDUSTRY DEPARTMENT CIRCULAR

United Nations Sanctions (Yemen) Regulation 2019

(Amendment) Regulation 2022

This is to announce for general information that on 27 May 2022 the Government gazetted the United Nations Sanctions (Yemen) Regulation 2019 (Amendment) Regulation 2022 ("the Amendment Regulation") (L.N. 123 of 2022).

2.Made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), the Amendment Regulation amends the United Nations Sanctions (Yemen) Regulation 2019 to implement sanctions in respect of Yemen as imposed and renewed by the United Nations Security Council under Resolution 2624.

3.The sanctions implemented under the United Nations Sanctions (Yemen) Regulation 2019 as amended by the Amendment Regulation include:

  • prohibition against the supply, sale, transfer or carriage of arms or related materiel to certain persons or entities;
  • prohibition against the provision of certain technical assistance, training or financial or other assistance to certain persons or entities;
  • prohibition against making available to, or for the benefit of, certain persons or entities any funds or other financial assets or economic resources;
  • prohibition against dealing with funds or other financial assets or economic resources belonging to, or owned or controlled by, certain persons or entities; and
  • prohibition against entry into or transit through the Hong Kong Special Administrative Region by certain persons.

4.An English version and a Chinese version of the UNSC documents relating to the Amendment Regulation are available at the Information Counter on 1/F, Trade and Industry Tower for public inspection. These documents can also be found at UN website http://www.un.org.

WARNING

5.Contravention to the prohibitions imposed by the Amendment Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

6.This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Amendment Regulation should refer to the Government Gazette for details. The prohibitions in the Amendment Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
