UNITED NATIONS SANCTIONS (SOMALIA) REGULATION
This is to announce for general information that on 27 March 2009 the Government gazetted the United Nations Sanctions (Somalia) Regulation (L.N. 58 of 2009).
2.This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), is to give effect to certain decisions in Resolution 733(1992) as adopted by the Security Council (SC) of the United Nations (UN) on 23 January 1992, as elaborated and amended by Resolutions 1356 (2001), 1425 (2002), 1725 (2006), 1744 (2007) and 1772 (2007) as adopted by the SC between 19 June 2001 and 20 August 2007, and Resolution 1844 (2008) as adopted by the SC on 20 November 2008. The Regulation covers, among others, prohibition against:
- the supply, delivery or carriage of weapons or military equipment to certain persons;
- the provision of advice, assistance or training in certain circumstances;
- making available to, or for the benefits of, certain persons or entities any funds or other financial assets or economic resources; and
- entry into or transit through the HKSAR by certain persons.
3.The new Regulation is a consolidated instrument which gives effect to certain decisions of the Security Council in Resolution 1844 (2008) and continues to give effect to a decision of the Security Council in Resolution 733 (1992). As a result, references to Somalia in the United Nations Sanctions (Arms Embargoes) Regulation (Cap. 537 sub. leg. E) are removed.
WARNING
4.Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.
IMPORTANT NOTE
5.This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
