TRADE AND INDUSTRY DEPARTMENT CIRCULAR
United Nations Sanctions (Afghanistan) Regulation 2022 and United Nations Sanctions (Afghanistan) Regulation 2012 (Repeal) Regulation
This is to announce for general information that on 14 April 2022 the Government gazetted the United Nations Sanctions (Afghanistan) Regulation 2022 ("the 2022 Regulation") (L.N. 47 of 2022) and United Nations Sanctions (Afghanistan) Regulation 2012 (Repeal) Regulation ("the Repeal Regulation") (L.N. 48 of 2022).
2.Made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), the 2022 Regulation implements all sanctions and corresponding exemptions, including those under the United Nations Security Council (UNSC) Resolution 2615, imposed by the UNSC against Afghanistan. Consequential to the making of the 2022 Regulation, the Repeal Regulation repeals the United Nations Sanctions (Afghanistan) Regulation 2012.
3.The sanctions implemented under the 2022 Regulation include:
- prohibition against the supply, sale, transfer or carriage of arms or related materiel to certain persons or entities;
- prohibition against the provision of technical advice, assistance or training related to military activities in certain circumstances;
- prohibition against making available to, or for the benefit of, certain persons or entities any funds or other financial assets or economic resources;
- prohibition against dealing with funds or other financial assets or economic resources belonging to, or owned or controlled by, certain persons or entities; and
- prohibition against entry into or transit through the Hong Kong Special Administrative Region by certain persons.
4.An English version and a Chinese version of the UNSC documents relating to the 2022 Regulation and the Repeal Regulation are available at the Information Counter on 1/F, Trade and Industry Tower for public inspection. These documents can also be found at UN website http://www.un.org.

5.Contravention to the prohibitions imposed by the 2022 Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.
IMPORTANT NOTE
6.This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the 2022 Regulation and the Repeal Regulation should refer to the Government Gazette for details. The prohibitions in the 2022 Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
