Dear Sirs,
Further to Commercial Information Circular (CIC) No. 963/2025 dated 5 November 2025 on the US’ modifications to additional duties and reciprocal tariff rates on products of China (including Hong Kong), the US President signed on 20 February 2026 an executive order announcing that the additional duties imposed pursuant to the International Emergency Economic Powers Act (IEEPA) shall no longer be in effect and shall no longer be collected effective from 24 February 2026.
DETAILS
2.Pursuant to the IEEPA, the US President signed Executive Order 14195 on 1 February 2025 announcing that all articles that are products of China shall be subject to an additional 10% ad valorem rate of duty with effect from 4 February 2025. On 5 February 2025, the US announced that the concerned articles include products of Hong Kong, with subsequent modifications. On 4 November 2025, the US modified the additional tariffs for products of China (including products of Hong Kong) to 10% effective from 10 November 2025.
3.On 2 April 2025, the US President invoked his authority under the IEEPA and signed Executive Order 14257 imposing reciprocal tariff on all imports from all trading partners effective from 5 April 2025, with subsequent modifications. On 4 November 2025, the US announced the continuation of the suspension of the heightened reciprocal tariffs on products of China (including products of Hong Kong) until 10 November 2026. As such, the 10% reciprocal tariff shall remain in effect during this suspension period.
Latest developments
4.On 20 February 2026, the US President signed an executive order announcing that the additional duties imposed pursuant to IEEPA in a number of executive orders, including the additional tariffs for products of China (including products of Hong Kong) imposed under Executive Order 14195, as amended and the reciprocal tariff imposed under Executive Order 14257, as amended, shall no longer be in effect and no longer be collected for goods entered for consumption or withdrawn from warehouse for consumption effective from 24 February 2026. The US shall determine whether modifications to the Harmonized Tariff Schedule of the United States are necessary to effectuate this order and may make such modifications through notice in the Federal Register (FR).
5.The Executive Order and the Presidential Proclamation of 20 February 2026, titled “Continuing the Suspension of Duty-Free De Minimis Treatment for All Countries” and “Imposing a Temporary Import Surcharge to Address Fundamental International Payments Problems” respectively, are unaffected by this order. For details, please refer to CIC Nos. 184/2026 and 185/2026 of 23 February 2026. This order affects only the additional duties imposed under IEEPA pursuant to the Executive Orders as described in this order. This order does not affect any other duties, including duties imposed under section 232 of the Trade Expansion Act of 1962, as amended, and section 301 of the Trade Act of 1974, as amended.
