Dear Sirs,
Further to Commercial Information Circulars (CICs) No. 792/2025 dated 16 September 2025 and No. 951/2025 dated 3 November 2025, the US Trade Representative (USTR) announced on 26 November 2025 the further extension of exclusions for certain products from the US’ additional tariffs on Mainland products under the Section 301 investigation until 10 November 2026.
2.Pursuant to the USTR’s Section 301 investigation findings released in March 2018, the US has imposed additional tariffs on certain Mainland products since July 2018. The USTR also initiated exclusion processes for stakeholders to submit requests for the exclusion of specific products from the additional tariffs and granted exclusions periodically on specific products. On 30 May 2024, the USTR issued a Federal Register (FR) notice announcing the extension of 164 exclusions through 31 May 2025 (as listed in Annex C to the FR notice on 30 May 2024). Subsequently, taking into consideration the USTR’s statutory four-year review findings of the Section 301 investigation on Chinese Mainland and at the direction of the then US President, the USTR issued an FR notice on 18 September 2024 announcing certain modifications to the actions taken in the subject investigation, including 14 exclusions covering certain solar manufacturing equipment through 31 May 2025 (as listed in Annex B to the FR notice on 18 September 2024). These 178 exclusions were further extended through 29 November 2025. 3.On 1 November 2025, the US published a White House’s fact sheet on reaching a trade and economic deal with China. Among others, the US shall further extend the expiration of certain Section 301 tariff exclusions, currently due to expire on 29 November 2025, until 10 November 2026.
4.On 26 November 2025, the USTR issued a notice announcing that in light of the US’ trade and economic deal with China, public comments received regarding the possible further extension of these exclusions, and pursuant to the direction of the US President, the USTR is extending until 10 November 2026 the 178 exclusions from the US’ additional tariffs on Mainland products under the Section 301 investigation. The modifications are announced in the annexes to the notice.
