Dear Sirs,
Further to the Commercial Information Circular No. 237/2021 of 12 April 2021, the European Commission (the Commission) published an Implementing Regulation (EU) 2021/1784 on 11 October 2021 to impose a definitive anti-dumping duty on imports of aluminium flat-rolled products originating in the Mainland of China. 2.Having determined that the imposition of anti-dumping duties was warranted, the Commission further examined whether the suspension of the anti-dumping measures imposed on the product concerned would be warranted in view of the conditions under Article 14(4) of Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union, which provides that, in the Union interest, anti-dumping measures may be suspended where market conditions have temporarily changed to an extent that injury would be unlikely to resume as a result of such suspension.
3.The Commission concluded that it is in the EU interest that the definitive anti-dumping duty imposed by the Implementing Regulation (EU) 2021/1784 on imports of aluminium flat-rolled products originating in the Mainland of China be suspended for a period of nine months, given the temporary nature of the change in market conditions concerning demand and supply, and in particular the current imbalance between demand and supply on the EU market; and published an Implementing Regulation (EU) 2021/1788 on 11 October 2021 to suspend the definitive anti-dumping duty imposed by Implementing Regulation (EU) 2021/1784. 4.Salient points of the two regulations are set out below -
(a) Product | : | Aluminium products, flat rolled, whether or not alloyed, whether or not further worked than flat rolled, not backed, without internal layers of other material,

(b) Rate of duty | : | 24.6% of the net, free-at-Union-frontier price before duty (except for a number of companies with individual duty rates from 14.3% to 21.4%). |
(c) Effective date | : | 12 October 2021 (Suspended for a period of nine months) (Should the situation which led to the suspension change subsequently, the Commission may repeal the suspension of the anti-dumping measures forthwith.) |
(d) Collection of duty | : | The amounts secured by way of the provisional anti-dumping duty under Implementing Regulation (EU) 2021/582 shall not be collected. |
