Dear Sirs,
This Circular informs traders of the entry into force of the part relating to Cambodia under the Free Trade Agreement between Hong Kong and the Association of Southeast Asian Nations (ASEAN) (Note 1). With the entry into force of the part for Cambodia, the AHKFTA will enter into force in full. The Certificate of Origin Circulars No. 7/2019, 11/2019, 1/2020, 2/2020 and 5/2020 are hereby superseded.
2.As stipulated in the previous Circulars, since June 2019, the AHKFTA have entered into force gradually for Hong Kong and the following nine ASEAN Member States (AMS), namely Brunei Darussalam, Indonesia, Laos, Malaysia, Myanmar, the Philippines, Singapore, Thailand and Vietnam (Note 2).
3.Subsequently, with the completion of its necessary procedures, the part relating to Cambodia under the AHKFTA will enter into force on 12 February 2021. Goods of Hong Kong origin for exportation to all AMS can benefit from the preferential tariff treatment under the AHKFTA.
4.To enjoy the preferential tariff treatment for exporting Hong Kong goods to the AMS, Hong Kong traders need to comply with the relevant preferential rules of origin and fulfil the related requirements. Applications for certificates of origin should be made to the Trade and Industry Department or Government Approved Certification Organizations of Hong Kong (Note 3). For details, please refer to the rules of origin, documentary requirements, record keeping requirements, relevant issues for exporting Hong Kong-origin goods to the AMS under the AHKFTA, and details on the application procedures and conditions for Certificate of Hong Kong Origin - Form AHK and Movement Confirmation as set out in the following Certificate of Origin Circulars:
