UNITED NATIONS SANCTIONS (AFGHANISTAN) (AMENDMENT) REGULATION 2002

This is to announce for general information that on 19 July 2002 the Government gazetted the United Nations Sanctions (Afghanistan) (Amendment) Regulation 2002 (L.N. 134 of 2002).

  1. This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), amends the United Nations Sanctions (Afghanistan) Regulation (L.N. 229 of 2000) to give effect to the decisions of the Security Council of the United Nations in Resolutions 1388 and 1390 of 15 and 16 January 2002. The Regulation covers, among others, the following:

    1. the prohibition of the supply, delivery, exportation and the carriage of any arms and related material, including weapons, ammunition, military vehicles, military equipment and paramilitary equipment, and any component for the aforementioned to relevant persons or undertakings (Usama bin Laden, the Al-Qaida Organization, the Taliban and their associates);

    2. the prohibition of the provision of any technical advice, assistance or training related to military activities to relevant persons or undertakings;

    3. the prohibition of the making of any funds or other financial assets or economic resources available for the benefit of relevant persons or undertakings;

    4. the restriction on entry into or transit of relevant persons through the Hong Kong Special Administrative Region; and

    5. the lifting of the sanctions against Ariana Afghan Airlines aircraft and any aircraft owned, leased or operated by or for the Taliban.

WARNING

  1. Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

  1. This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
