UNITED NATIONS SANCTIONS (SUDAN) (AMENDMENT) REGULATION 2005 

This is to announce for general information that on 8 July 2005 the Government gazetted the United Nations Sanctions (Sudan) (Amendment) Regulation 2005 (L.N. 124 of 2005).

  1. This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), is to give effect to a decision of the Security Council of the United Nations (UN) in Resolution 1591 of 29 March 2005 to extend the scope of certain sanctions imposed by the Security Council in Resolution 1556 (2004) and to implement certain new sanctions. The Regulation covers, among others, the following :
  1. the prohibition against supply, delivery and carriage of arms and related material, including weapons, ammunition, military vehicles, military equipment and paramilitary equipment, and any component for the aforementioned, to persons connected with Sudan1 , except for those arms and related material
  1. that are for monitoring, verification or peace support operations, including such operations led by regional organizations, that are authorized by the UN or are operating with the consent of the relevant parties;

  2. that are non-lethal military equipment intended solely for humanitarian, human rights monitoring or protective use;

  3. that are protective clothing, including flak jackets and military helmets, for the personal use of the personnel of the UN, human rights monitors, representatives of the media, humanitarian and development workers and associated personnel; 

  4. that are supplied in support of implementation of the Comprehensive Peace Agreement; or

  5. that are military equipment and supplies into the Darfur region that are approved in advance by the relevant UN Authority upon a request by the Government of Sudan;

  1. the prohibition against provision of technical assistance or training related to the supply, delivery, manufacture, maintenance or use of arms and related material, including weapons, ammunition, military vehicles, military equipment and paramilitary equipment, and any component for the aforementioned, to persons connected with Sudan, except for those prohibited goods under para.2(a)(i), (ii) and (iv) above;

  2. the prohibition against entry into or transit through the Hong Kong Special Administrative Region by certain persons specified by the relevant UN Authority, except for those cases where the UN Authority concerned determines on a case-by-case basis that the relevant entry or transit is justified on the ground of humanitarian need, including religious obligation; or it concludes that the relevant entry or transit would further the objectives of the resolutions of UN Security Council, for the creation of peace and stability in Sudan and the region; and 

  3. the prohibition against making available funds or other financial assets or economic resources to or for the benefit of a relevant person or a relevant entity designated by the UN Authority concerned.

WARNING

  1. Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

  1. This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.

1: "Person connected with Sudan" means any non-governmental entity or individual, including the Janjaweed, operating in Darfur; all the parties to the N'djamena Ceasefire Agreement; or any other belligerents in Darfur.
