TRADE AND INDUSTRY DEPARTMENT CIRCULAR
UNITED NATIONS SANCTIONS
(DEMOCRATIC PEOPLE'S REPUBLIC OF KOREA) REGULATION
This is to announce for general information that on 15 June 2007 the Government gazetted the United Nations Sanctions (Democratic People's Republic of Korea) Regulation (L.N. 120 of 2007).
- This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), is to give effect to a decision of the Security Council (SC) of the United Nations (UN) in Resolution 1718 of 14 October 2006. The Regulation provides, among others, for the following:
- the prohibition against supply, delivery, transfer or carriage of certain items, material, equipment, goods or technology to the Democratic People's Republic of Korea (DPRK);
- the prohibition against the procurement of certain items from the DPRK;
- the prohibition against provision and acceptance of certain training, services, advice or assistance to or from the DPRK;
- the prohibition against making available to or for the benefit of certain persons or entities any funds or other financial assets or economic resources; and
- the prohibition against entry into or transit through the Hong Kong Special Administrative Region of certain persons;
A list of luxury goods in relation to the sanctions is set out in the Schedule of the Regulation.
- An English version and a Chinese version of the UN documents S/2006/814, S/2006/815, S/2006/853 and S/2006/853/Corr.1. are available at the Information Counter on G/F, Trade and Industry Department Tower for public inspection. These UN documents can also be found at the UN website http://www.un.org.
Warning
- Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.
Important Note
- This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
