UNITED NATIONS SANCTIONS (DEMOCRATIC REPUBLIC OF THE CONGO)
REGULATION 2008

This is to announce for general information that on 25 January 2008 the Government gazetted the United Nations Sanctions (Democratic Republic of the Congo) Regulation 2008 (L.N. 17 of 2008).

  1. This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537), is to give effect to a decision of the Security Council of the United Nations (UN) in Resolution 1771 of 10 August 2007 to renew the sanctions imposed by UN Security Council Resolutions 1596 (2005), 1649 (2005), 1671 (2006) and 1698 (2006). The Regulation covers, among others, the following: 
  1. the prohibition against the direct or indirect supply, sale or transfer of arms and related materials to persons in the territory of the Democratic Republic of the Congo;
  1. the prohibition against provision to such persons of assistance, advice or training related to military activities;
  1. the prohibition against entry into or transit through the Hong Kong Special Administrative Region of certain persons; and
  1. the prohibition against making available to or for the benefit of certain persons or entities any funds or other financial assets or economic resources.

This Regulation shall expire at midnight on 15 February 2008.

WARNING

  1. Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine.

IMPORTANT NOTE

  1. This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
