Under Section (3) (2) of the Import and Export Ordinance,
Cap. 60, the subject Certificate of Origin is suspended with immediate effect.
No change to the Certificate of Origin is allowed. It cannot be used for
any purpose until further notice.
According to investigations carried out by Customs and Excise Department
(C&ED), there are some irregularities on this Certificate of Origin.
The matter is to be considered by me. Should I be satisfied that the Certificate
of Origin concerned were founded with irregularities, I may decide to take
action to revoke the Certificate of Origin. You are hereby invited to make
written representations to the issuing authority to: (a) refute the investigation
result referred above; (b) give reasons on why the issuing authority should
not revoke the Certificate of Origin concerned; and (c) provide any other
relevant facts and information which you wish the issuing authority to take
into account. Any representations you make should reach me within 7 days
from the date of this message. Your representations will be considered by
me in reaching a decision on the matter.

The subject Certificate of Origin is re-activated. The earlier
suspension is hereby superseded. You may continue to use this Certificate
of Origin to cover export of goods as described in the Certificate. You
are hereby reminded that should this Certificate of Origin be discovered
at a later date that it is in breach of any of the conditions of the Certificate
of Origin as stipulated in various Certification Branch Circulars, the Director-General
of Trade and Industry may take any legal and / or administrative actions
as appropriate. |

Further to the earlier suspension, the issuing authority has
given careful consideration to the matter. In the event, the issuing authority
is satisfied that there are some irregularities on this Certificate of Origin.
Under Section (3) (2) of the Import and Export Ordinance, Cap. 60, the subject
Certificate of Origin is hereby revoked and is no longer valid. You are
reminded that the revocation of this Certificate of Origin is without prejudice
to any legal and / or administrative actions which the issuing authority
may take in respect of this Certificate of Origin.
According to Section (3) (5) of the Import and Export Ordinance, Cap. 60,
all copies of the COs which have been cancelled, revoked or suspended by
the Director-General and all copies thereof in the possession of any person
shall be surrendered immediately to the Director-General. Any person who
contravenes Section (3) (5) is liable on conviction to a fine of five thousand
dollars and to imprisonment for three months. You are therefore reminded
to surrender the above certificates to this Department immediately. The
certificate should be surrendered within 7 days from the date of this message.

Under Section (4) (1) (c) of the Protection of Non-Government Certificates
of Origin Ordinance, Cap. 324, the subject Certificate of Origin is hereby
revoked and is no longer valid. You are reminded that the revocation of
this Certificate of Origin is without prejudice to any legal and / or administrative
actions which the issuing authority may take in respect of this Certificate
of Origin.
According to Section (4) (4) of the Protection of Non-Government Certificates
of Origin Ordinance, Cap. 324, any person who having been informed by the
issuing authority of the revocation of a certificate of origin; and having
in his possession or control such certificate of origin or any copy thereof
fails forthwith to surrender the certificate or copies issued on paper to
the issuing authority commits an offence and is liable to a fine of five
thousand dollars and to imprisonment for three months. You are therefore
reminded to surrender the above certificates to the issuing authority immediately.
The certificate should be surrendered within 7 days from the date of this
message.
