Malaysia : Consumer Protection Regulations on Safety of Toys

The Ministry of Domestic Trade and Consumer Affairs (MDTCA) of Malaysia has recently proposed draft regulations with regard to safety of toys, namely "Consumer Protection (Compliance With Safety Standards) Regulations 2008" and "Consumer Protection (Safety Standards For Toys) Regulations 2008" under the "Consumer Protection Act 1999".

DETAILS

  1. The draft Consumer Protection (Compliance With Safety Standards) Regulations 2008 specify the general procedural requirements with regard to safety standards of consumer goods which include the safety and marking requirements, certification of approval, conformity assessment report, offences and penalties, maintenance of records, authorised agency, transitional period for toys which are marketed in Malaysia. On the other hand, the draft Consumer Protection (Safety Standards For Toys) Regulations 2008 state that toys that are sold or supplied in Malaysia must conform to the safety standards of MS ISO 8124-1, MS ISO 8124-2, MS ISO 8124-3, MS 1774: Parts 4 to 6, and MS 1725.

  1. The draft regulations are upon gazetting. All manufacturers, importers, distributors and retailers will be given a grace period of not more than twelve months to comply with the safety standards for all toys sold/supplied/displayed in Malaysia. Copies of the proposed regulations are in the Annexes to this circular.

  1. Malaysia would consider comments from its trading partners before it implements the proposed regulations. Any such comments should reach the following on or before 5 January 2009:
