US : Final Rule on Guidelines and Requirements for Mandatory Recall Notices

The US Consumer Product Safety Commission (CPSC) issued in the Federal Register (FR) notice of 21 January 2010 a final rule establishing guidelines and requirements for mandatory recall notices as required by Section 214 of the US Consumer Product Safety Improvement Act of 2008 (CPSIA). The final rule will be effective on 22 February 2010. Regardless of when a product subject to a recall was manufactured, all mandatory recalls ordered pursuant to Sections 12, 15(c) or 15(d) of the US Consumer Product Safety Act (CPSA) are subject to the guidelines and requirements as from the aforementioned effective date.

  1. The final rule contains the CPSC's interpretation of information which must appear on mandatory recall notices ordered by the CPSC or a US district court pursuant to the CPSA. The final rule also contains CPSC's guidelines for additional information that the CPSC or a court may order to be included on a mandatory recall notice. Details of the final rule including the applicability, definitions, guidelines and policies, and recall notice content requirements are set out in the FR notice.

    (http://www.cpsc.gov/businfo/intl/newusreq_ch.html) for information. Traders are strongly advised to seek clarifications with their importers in the US in order to comply with the necessary requirements.
