Canada : New Labelling and Registration Requirements for Padded Undergarments and Shoulder Pads and Trimmings in Articles of Clothing

The Technical Standards and Safety Authority (TSSA) recently made amendments to the Ontario Regulation 218/01 (Upholstered and Stuffed Articles) under the Technical Standards and Safety Act, 2000. The regulatory amendments include exemption, labelling and content declaration issues.

DETAIL

  1. The Ontario Regulation 218/01, administered by TSSA, protects the public from potential hazards related to the use of unclean or used upholstered and stuffed articles. By regulation, all manufacturers who manufacture upholstered and stuffed articles for sale in Ontario, Québec and Manitoba must be registered. Agents, importers, distributors and retailers are not eligible for registration; however, they may register on behalf of a domestic and/or foreign manufacturer. TSSA also requires that all upholstered and stuffed articles offered for sale in Ontario, Québec and Manitoba must affix labels to their products in the prescribed format, namely Forms 1 - 6. In particular, for clothing and miscellaneous articles, a label in Form 2 should be used.

  2. Under the amended regulations, amongst others, padded undergarments and shoulder pads and trimmings in articles of clothing that are sold in the Canadian provinces of Ontario, Québec and Manitoba are subject to the labelling requirements with immediate effect. Manufacturers of such items must be registered with each of these provinces where the articles would be sold.
  1. TSSA also requires that a label in Form 2 (Annex)(pdf format) be affixed to an upholstered or stuffed article with the generic names of all stuffing materials used in the article indicated and listed in order of predominance, by volume but not by percentage. Specifications of the labelling requirements are detailed in the Ontario Regulation 254/08. For more information of the regulations, traders are strongly advised to seek clarifications with their importers in Canada in order to comply with the necessary requirements.
