Guidance Notes on Completion of Textiles Notifications lodged in Paper Form
Traders registered under the Textiles Trader Registration Scheme (TTRS), subject to their compliance with a set of conditions, are exempted during the validity period of their registration, from the licensing requirement of the Import and Export Ordinance in respect of textiles which fall within the scope of the scheme. When a registered textiles trader relies on the exemption granted to him under the TTRS to import or export such textiles, he must cover his imports and exports with notifications.

Textiles notifications can be lodged in paper or electronic mode to the Trade and Industry Department. This guidance note sets out the various types of paper notifications and specifies how they should be completed and lodged. Types of Textiles Notifications

There are three types of textiles notifications:

Paper notifications must be completed according to specified requirements. The requirements applicable to all types of notifications are set out at Annex 1 (pdf format) and those specific for import notification are set out at Annex 2 (pdf format). Specimens of notifications illustrating the application of these requirements are at Annexes 3 to 5 (pdf format). Before completing a notification, a registered textiles trader is advised to read carefully the latest conditions of exemption set out in Textiles Trader Registration Circulars issued by the Department and the Conditions of Use at the back of the notification forms.

Notifications which are not completed in accordance with the specified requirements are invalid and cannot be used to cover imports and exports of textiles.

For textiles notifications to be lodged in paper form, traders are reminded to use the appropriate forms, and to complete the notification forms properly without omission of any of the required particulars. All handwritings on paper textiles notifications must be legible. The Government takes a serious view on any abuse of the textiles control arrangements. Textiles traders who contravene or fail to comply with any of the conditions of exemption under the TTRS commit an offence. Notifications which are not completed in accordance with the specifications made by the Director-General of Trade and Industry are considered invalid. Importing or exporting textiles without a valid notification or licence constitutes an offence under the Import and Export Ordinance and the traders concerned are liable on conviction to a maximum fine of $500,000 and to imprisonment for two years. The Director-General of Trade and Industry may also take administrative actions against the textiles traders concerned independent and irrespective of any prosecution action which may be instituted under the Import and Export Ordinance or under relevant Laws of Hong Kong, irrespective of whether the textiles notifications concerned have been amended, cancelled or withdrawn, or whether retrospective consignment-specific import/export licences have been applied and approved. Such administrative actions may involve but shall not necessarily confine to revocation and suspension of any exemption and/or TTR registration granted without refund of the registration fee and refusal to renew any exemption and/or registration granted. Where circumstances justify, the offending textiles traders may be debarred from all licensing facilities.
