TRADE AND INDUSTRY DEPARTMENT CIRCULAR

UNITED NATIONS SANCTIONS (LIBYA) REGULATION 2011

This is to announce for general information that on 30 June 2011 the Government gazetted the United Nations Sanctions (Libya) Regulation 2011 (L.N. 114 of 2011).

2. This Regulation, made under section 3 of the United Nations Sanctions Ordinance (Cap. 537, Laws of Hong Kong), is to implement sanctions against Libyan Arab Jamahiriya ("Libya") imposed by the United Nations Security Council under Resolutions 1970 and 1973. The Regulation covers, amongst others, the following: 

1. prohibition against the supply, sale, transfer or carriage of arms or related materiel to Libya or certain persons;
   
   

2. prohibition against the provision of assistance or training related to military activities or to the provision, maintenance or use of any arms or related materiel to certain persons;
   
   

3. prohibition against the procurement of arms or related materiel from Libya or person connected with Libya by certain persons or by using certain ships, aircraft or vehicles;
   
   

4. prohibition against making available to certain persons or entities funds or other financial assets or economic resources, or dealing with funds or other financial assets or economic resources of certain persons or entities;
   
   

5. prohibition against entry into or transit through the HKSAR by certain persons;
   
   

6. prohibition against certain aircraft flying into Libyan air space; and
   
   

7. prohibition against aircraft carrying arms or related materiel or armed mercenary personnel or Libyan aircraft to take off from or land in the HKSAR or fly within the HKSAR air space.
   

WARNING

3. Contravention to the prohibitions imposed by the Regulation attracts substantial penalties which may amount in some cases to imprisonment for 7 years and/or a fine. 

IMPORTANT NOTE

4. This circular is NOT a statement of the Laws of Hong Kong and has NO legal status. Anyone interested in the Regulation should refer to the Government Gazette for details. The prohibitions in the Regulation will apply to any person and company/registered business irrespective of and notwithstanding the possession of valid licences issued by the Director-General of Trade and Industry under the Import and Export Ordinance (Cap. 60) and its subsidiary legislation and other Enactments.
