Rules and regulations promulgated by the Mainland authorities relating to the implementation of commitments under CEPA :

Video and Sound Recording Products Distribution

• According to the "Administrative Provisions on the Publication Market" (Decree of General Administration of Press and Publication and Ministry of Commerce No. 10 - Jun 2016)  (in Chinese only), entities operating publication wholesale businesses shall meet the following conditions:
  1. Having completed the industrial and commercial registration and be qualified as legal persons;
  2. Having included publication wholesale in the business scope of its industrial and commercial registration;
  3. Having equipment and fixed business premises suitable for publication wholesale, and the total area of the business premises shall not be less than 50 square meters;
  4. Having sound management rules and an information management system in line with the industry standards.
• According to the "Administrative Provisions on the Publication Market" (Decree of General Administration of Press and Publication and Ministry of Commerce No. 10 - Jun 2016)  (in Chinese only), entities or individuals operating publication retail businesses shall meet the following conditions:
  1. Having completed the industrial and commercial registration;
  2. Having included publication retail in the business scope of its industrial and commercial registration;
  3. Having fixed business premises.

Video and Sound Recording Products Production

• According to the "Administrative Provisions on the Production of Video and Sound Recording Products (2017 Revision - Dec 2017) (in Chinese only), Hong Kong Service Suppliers (HKSS) applying to operate the production of video and sound recording products in the Mainland shall meet the following conditions:
  1. Having the name and articles of association of the producing entity;
  2. Having the institutional framework and personnel specialized in the production of video and sound recording products as required by its business scope, and the amount of specialized employees shall not be less than 5;
  3. Having necessary technical equipment;
  4. Having fixed business premises;
  5. Meeting the other requirements stipulated by the laws and regulations.
