 Textiles Trader Registration Circular No. 6/2004

Export of Textiles to Countries Acceding to the European Union on 1 May 2004

Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia and Slovenia shall accede to the European Union (EU) on 1 May 2004. In relation to the developments, textiles traders registered under the Textiles Trader Registration Scheme (TTRS) are requested to note the following arrangements.

Impact on TTRS

  1. Under the existing exemption arrangements, the TTRS does not apply to cover exports of textiles of Hong Kong origin to the EU. In this connection, after the accession of the ten new Member States (MSS) to the EU on 1 May 2004, the exemption from licensing requirements for exports of textiles of Hong Kong origin to the new MSS will be discontinued. Detailed arrangements are set out below:
  1. Exports of Textiles of Hong Kong Origin to the New MSS on or before 30 April 2004

Exports of textiles of Hong Kong origin to the new MSS currently exempted from licensing requirement under the TTRS which are to be exported under the cover of Export Notification I (Textiles) must be shipped by mid-night on 30 April 2004. The term 'shipped' means the consignments in question must be cleared of Hong Kong waters en route to the new MSS. The Director-General of Trade and Industry at all times reserves the right to determine whether the goods have been shipped. In the event the Director-General decides that, within the context of the textiles export control system, shipment has not been properly made, he may take administrative actions against the parties concerned.

  1. Exports of Textiles of Hong Kong Origin to the New MSS on or after 1 May 2004

With effect from 1 May 2004, all exports of textiles of Hong Kong origin to the new MSS will be subject to the administrative arrangements agreed between Hong Kong and the EU to govern the exports of textiles to the EU market. Consequently, exemption from licensing requirement for exports of textiles of Hong Kong origin to the new MSS under the TTRS will be discontinued. In other words, Export Notification I (Textiles) will not be accepted to cover consignments shipped on or after 1 May 2004, and exports of textiles of Hong Kong origin to the new MSS have to be covered by Export Licence (Textiles) Form 4 or Export Licence (Textiles) Form 5, as the case may be, in accordance with the control arrangements for the EU, which were announced in the Notice to Exporters: Series 2 (EU) No. 12/2004 cum Certificate of Origin Circular No. 6/2004 of 8 April 2004.

  1. Imports of Textiles from the New MSS, Re-exports of Textiles to the New MSS and Transhipments of Textiles from or to the New MSS

There will be no change to the existing TTRS licensing exemption arrangements regarding imports of textiles from the new MSS, re-exports of textiles to the new MSS and transhipments of textiles from or to the new MSS.
