Additional Requirements under the

Outward Processing Arrangement (OPA)

for Certain Textile Made-up Articles

Introduction

Certificate of Origin Circular No. 5/01 dated 11 June 2001 informs the trade of an updated list of Hong Kong's origin rules for specific products. This circular serves to inform the trade of the requirements under the Outward Processing Arrangement (OPA) for textile made-up articles made from yarn.

Product Coverage

  1. For certain products under HK HS Codes 6117.10, 6209.2050, 6213, 6214, 6301-6304, 6307.10 and 6307.90, namely "textile made-up articles made from yarn, including scarves, shawls, mufflers, mantillas, veils, handkerchiefs, babies' diapers and napkins, blankets, bed linens (e.g. bedsheets, pillow covers, duvet covers), table linens, toilet linens, kitchen linens, curtains, bedspreads, floor cloths, dish cloths and dusters", an origin criterion "manufacture from yarn" has been introduced. The corresponding principal manufacturing process is "weaving or knitting".

Additional Export/Re-import Requirements under the Outward
Processing Arrangement (OPA)

  1. Manufacturers who have conducted weaving/knitting in Hong Kong for the products mentioned in paragraph 2 above and would like to subcontract cutting, sewing and other finishing processes outside Hong Kong under the OPA should note that, in addition to the existing OPA documentary requirements, they have to observe the following additional requirements :

    1. in the "Full Description of Goods including Article No." column of the OPA Combined Form, full details of the goods before and after outward processing should be clearly stated. These include the description of goods before and after outward processing, the construction and quantity of the grey/finished fabric in terms of both weight and size, and the conversion of the grey/finished fabric to the finished product (e.g. 65% cotton 35% polyester woven grey fabric of weight 1,260 kg, size 4,500 sq m and construction "60 x 60" will be converted into 1,850 pcs of 65% cotton 35% polyester woven table cloth of size 152cm x 152cm). One Combined Form should only cover one style of finished product; and

    2. a sample of the grey/finished fabric identical to that to be exported of size no less than 20cm x 15cm should be firmly affixed to the back top right hand corner of the photo backing sheet.

  2. Customs officers at border control points will examine whether the above additional requirements are complied with by traders. Any deviation from the above or other existing requirements under the OPA may result in refusal to validate the OPA Combined Form for the consignment in question by Customs officers and other appropriate action.

Warning

  1. The Trade and Industry Department works closely with the Customs and Excise Department, through checks and inspections, to ensure that manufacturers registered under the OPA are in compliance with all the registration conditions and requirements. Abuses of the OPA system are taken seriously. In addition to prosecution under the Import and Export Ordinance which provides for a penalty up to a fine of HK$500,000 and 2 years' imprisonment, the Trade and Industry Department may take administrative actions against the parties concerned irrespective of whether they have been prosecuted. Such administrative actions may involve, but shall not necessarily be confined to, any of the following : refusal to validate a Combined Form; refusal to validate a Production Notification; refusal to issue a Certificate of Origin; suspension of certification facilities; and cancellation of Factory Registration and OPA Registration.
