Commercial Information Circular No. 840/2017

European Union (EU)* : Amending the Council implementing regulations that imposed definitive anti-dumping and countervailing duties on and repeal of the acceptance of an undertaking offered in connection with the imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China

Further to Commercial Information Circular No. 185/2017 of 7 March 2017 concerning the partial interim review of the anti-dumping and countervailing measures on imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the Mainland of China, the European Commission (the Commission) has published an implementing regulation, which will enter into force 15 days from 16 September 2017, at:

2.The Commission, having recognised that the existing undertaking minimum import price (MIP) mechanism did not follow global price decreases and hence not reflecting the non-injurious price to the industry in the EU, it will impose a quarterly adjusted variable MIP to replace the original price undertaking. The acceptance of the undertaking offered will also be repealed accordingly .

3.The new MIP will only apply to cooperating companies that were still part of the price undertaking or had withdrawn voluntarily from the undertaking without any issues identified by the Commission. The names of these companies are listed in the Annex of the regulation.

4.The Commission devised a decreasing MIPs system and considered that there should be separate MIPs for mono-crystalline and multi-crystalline modules and cells as the four product types have distinctive prices, outputs, properties and are easily distinguished by customs authorities. The separate new MIPs are tabulated at Article 1/Article 3 of the regulation.
