European Union (EU)* : Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Certain Iron or Steel Fasteners Originating in the Mainland of China, as Extended to Imports Consigned from Malaysia, whether Declared as Originated in Malaysia or not

Further to the Commercial Information Circular No. 367/2013 of 14 May 2013, the Council of the EU (the Council) has published an implementing regulation to terminate the partial interim review of the anti-dumping measures applicable to imports of certain iron or steel fasteners originating in the Mainland of China, as extended to imports consigned from Malaysia, whether declared as originated in Malaysia or not. 2.On 14 May 2013, the European Commission (the Commission) initiated a partial interim review of the anti-dumping measures imposed on imports of certain iron or steel fasteners originating in the Mainland of China, as extended to imports consigned from Malaysia, whether declared as originated in Malaysia or not, following a request lodged by an exporting producer from Malaysia, Malaysian Precision Manufacturing SDN BHD (the applicant).

3.In order to obtain the information deemed necessary for investigation, the Commission sent a questionnaire to the applicant, who did not provide any reply within the deadline set for that purpose. On 18 June 2013, the applicant withdrew its request for the partial interim review, claiming, inter alia, that it was not able to provide the Commission with the data requested in the questionnaire as regards its related companies.

4.While the Commission found no compelling reasons existed which would lead to the conclusion that termination would not be in the Union interest, interested parties were informed of the intention to terminate the review investigation and were given the opportunity to comment. Given no comments were received, it is concluded that partial interim review concerning the anti-dumping measures applicable to imports of certain iron or steel fasteners originating in the Mainland of China, as extended to imports consigned from Malaysia, whether declared as originated in Malaysia or not, should be terminated without amending the anti-dumping measures in force as extended.

5.The implementing regulation shall enter into force on 26 October 2013.

BACKGROUND

6.Definitive anti-dumping duty on certain iron or steel fasteners originating in the Mainland of China has been imposed since 1 February 2009. Consequent to a circumvention investigation, the anti-dumping duty has been extended with effect from 27 July 2011 to imports of the same products consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not. As a result of two reviews initiated in March 2012 and June 2012, the applicable rate of the definitive anti-dumping duty has been amended to 74.1% of the net, free-at-Union-frontier price before duty (except for a number of companies whose individual duty rates range from 0% to 69.7%).
