European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Molybdenum Wire, Containing by Weight at least 99.95% of Molybdenum, of which the Maximum Cross-sectional Dimension Exceeds 1.35 mm but does not Exceed 4.0 mm, Originating in the Mainland of China to Imports of Molybdenum Wire, Containing by Weight at least 97% of Molybdenum, of which the Maximum Cross-sectional Dimension Exceeds 1.35 mm but does not Exceed 4.0 mm, Originating in the Mainland of China

Further to the Commercial Information Circular No. 1078/2012 of 20 December 2012, the Council of the EU has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of molybdenum wire, containing by weight at least 99.95% of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China to imports of molybdenum wire, containing by weight at least 97% of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China. DETAILS

2.The European Commission (the Commission) published on 20 December 2012 a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain molybdenum wires originating in the Mainland of China. The regulation also made imports of molybdenum wire, containing by weight 97% or more but less than 99.95% of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm and currently falling within CN code ex 8102 96 00 (TARIC code 8102 96 00 30), originating in the Mainland of China subject to registration by the EU's customs authorities.

3.In view of the findings of the circumvention investigation, it was concluded that the definitive anti-dumping duty imposed on imports of molybdenum wires originating in the Mainland of China was circumvented by imports of certain slightly modified molybdenum wires originating in the Mainland of China. On this basis, the Council has adopted the implementing regulation to extend, with effect from 13 September 2013, the definitive anti-dumping duty imposed on imports of molybdenum wire, containing by weight at least 99.95% of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China, to imports of molybdenum wire, containing by weight at least 97% of molybdenum, of which the maximum cross-sectional dimension exceeds 1.35 mm but does not exceed 4.0 mm, originating in the Mainland of China, currently falling within CN code ex 8102 96 00 (TARIC code 8102 96 00 30). The implementing regulation also specifies that the duty will be collected on imports into the Union of molybdenum wire registered in accordance with, inter alia, the above-mentioned Commission's regulation of December 2012.

4.With the extension of the anti-dumping duty, the registration of imports of molybdenum wire in accordance with the Commission's regulation of December 2012 will also be discontinued.

BACKGROUND

5.Definitive anti-dumping duties on certain molybdenum wires originating in the Mainland of China have been imposed since 17 June 2010. The current duty in force is 64.3% of the net, free-at-Union-frontier price before duty. Consequent to a circumvention investigation, the definitive anti-dumping duty has been extended with effect from 13 January 2012 to imports of the same products consigned from Malaysia, regardless of whether they are declared as originating in Malaysia or not.
