European Union (EU)* : Termination of the Investigation on Possible Circumvention of Anti-dumping Measures Imposed on Imports of Certain Aluminium Foil Originating in the Mainland of China by Imports of Certain Aluminium Foil in Rolls which are Not Annealed and of a Width Exceeding 650 mm Originating in the Mainland of China

Further to Commercial Information Circular 858/2012 of 24 October 2012, the European Commission (the Commission) has published a regulation to terminate the investigation on possible circumvention of anti-dumping measures imposed on certain aluminium foil originating in the Mainland of China by imports of certain aluminium foil in rolls which are not annealed and of a width exceeding 650 mm originating in the Mainland of China. DETAILS

2.The Commission announced by a notice published on 23 October 2012 the initiation of an investigation on possible circumvention of anti-dumping measures imposed on certain aluminium foil originating in the Mainland of China by imports of certain aluminium foil in rolls which are not annealed and of a width exceeding 650 mm originating in the Mainland of China following a request lodged on 24 September 2012 by Symetal SA, Eurofoil Luxembourg SA, Alcomet and Hydro Aluminium Rolled Products GmbH, four Union producers of aluminium foil.

3.By letters of 3 and 4 April 2013 addressed to the Commission, however, the four Union producers formally withdrew their request. The Commission considered that the present investigation should be terminated since the investigation had not brought to light any considerations showing that such termination would not be in the Union interest. Interested parties were informed and given the opportunity to comment but no comments were received indicating that such termination would not be in the Union interest. The Commission has subsequently adopted the regulation to terminate the investigation on possible circumvention of anti-dumping measures imposed on certain aluminium foil originating in the Mainland of China by imports of aluminium foil of a thickness of not less than 0.008 mm and not more than 0.018 mm, not backed, not further worked than rolled, in rolls which are not annealed, of a width exceeding 650 mm and of a weight exceeding 10 kg and currently falling within CN code ex 7607 11 19 (TARIC code 7607 11 19 20) originating in the Mainland of China.

4.With the termination of the investigation, the registration of imports of the concerned products will also be discontinued.

5.The regulation shall enter into force on 4 July 2013.

BACKGROUND

6.Definitive anti-dumping duty on imports of certain aluminium foil originating in the Mainland of China has been imposed since 7 October 2009. The current rate of duty is 30.0% of the net, free-at-Union-frontier price, before duty (except for three companies whose individual duty rates ranging from 6.4% to 24.2%).

7.Separately, the EU has also imposed definitive anti-dumping duty on imports of certain aluminium foil in rolls originating in the Mainland of China since 14 March 2013. For further information, please refer to Commercial Information Circular No. 215/2013 of 13 March 2013.
