Further to the Commercial Information Circular No. 374/2012 of 24 May 2012, the Council of the EU ('the Council') has published a Council Implementing Regulation to extend the definitive anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China to imports of the same products consigned from Taiwan and Thailand, whether declared as originating in Taiwan and Thailand or not. The Regulation can be accessed through the following link:

DETAILS

2.The European Commission ('the Commission') published on 24 May 2012 a regulation to initiate an investigation into the possible circumvention of the anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China by imports of the same products consigned from Taiwan and Thailand. The regulation also required imports of the product concerned consigned from Taiwan and Thailand to be subject to registration.

3.Based on the findings of the circumvention investigation, the Council has decided that, with effect from 17 January 2013, the definitive anti-dumping duty imposed on imports of open mesh fabrics of glass fibres, of a cell size of more than 1.8 mm both in length and in width and weighing more than 35 g/m2, excluding fibreglass discs, originating in the Mainland of China, be extended to imports of the same products consigned from Taiwan and Thailand, whether declared as originating in Taiwan and Thailand or not, currently falling within CN codes ex 7019 51 00, and ex 7019 59 00 (TARIC codes 7019 51 00 12, 7019 51 00 13, 7019 59 00 12 and 7019 59 00 13).

4.The Commission may authorise by decision the exemption of imports from companies which do not circumvent the imposed anti-dumping measures from the extended anti-dumping duty. Request for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the entity requesting the exemption. The request must be sent to the following address:

European Commission
Directorate-General for Trade
Directorate H
Office: N-105 08/20
1049 Brussels
Belgium
Fax : +32 2295 6505

5.With the extension of the anti-dumping duty, the registration requirement of imports of the product concerned consigned from Taiwan and Thailand, whether declared as originating in Taiwan and Thailand or not, is discontinued from 17 January 2013.

BACKGROUND

6.Definitive anti-dumping duties on certain open mesh fabrics of glass fibres originating in the Mainland of China have been imposed since 10 August 2011. The current duty in force is 62.9% of the net, free-at-Union-frontier price, before duty (except for a number of companies whose individual duty rates range from 48.4% to 62.9%). Based on the finding of an earlier circumvention investigation, the Council has extended, with effect from 25 July 2012, the definitive anti-dumping duties to imports of the same products consigned from Malaysia, whether declared as originating in Malaysia or not.
