European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Bicycles Originating in the Mainland of China to Imports of Bicycles Consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether Declared as Originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not

Further to the Commercial Information Circular No. 770/2012 of 26 September 2012, the Council of the EU (the Council) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of bicycles originating in the Mainland of China to imports of bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not. 2.The European Commission (the Commission) published on 26 September 2012 a regulation to initiate an investigation of the possible circumvention of anti-dumping measures imposed on imports of bicycles originating in the Mainland of China. The regulation also made imports of bicycles consigned from Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not, subject to registration.

3.Following the circumvention investigation, the Council has decided that, with effect from 6 June 2013, the definitive anti-dumping duty imposed on imports of bicycles and other cycles (including delivery tricycles, but excluding unicycles), not motorised, originating in the Mainland of China be extended to imports of the same products consigned from the Indonesia, Malaysia, Sri Lanka and Tunisia, whether declared as originating in Indonesia, Malaysia, Sri Lanka and Tunisia or not, and currently falling within CN codes ex 8712 00 30 and ex 8712 00 70 (TARIC code 8712 00 30 10 and 8712 00 70 91) with the exemption of those produced by the companies listed in Article 1 of the implementing regulation.

4.The Commission may authorise by decision the exemption of imports from companies which do not circumvent the anti-dumping measures from the anti-dumping duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. 5.With the extension of the anti-dumping duty, the registration of imports established in accordance with the regulation published on 26 September 2012 will also be discontinued.

BACKGROUND

6.Definitive anti-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993. Based on the findings of a circumvention investigation, the definitive anti-dumping duty has been extended to imports of certain bicycle parts originating in the Mainland of China from 19 January 1997. The duty was also extended, for five years on each occasion, in July 2000, July 2005 and October 2011 as a result of the expiry or interim reviews conducted. On the basis of a recent interim review, the rate of definitive anti-dumping duty has been amended to 48.5% of the net, free-at-Union-frontier price before duty (except for three companies whose individual duty rates range from 0% to 19.2%) with effect from 6 June 2013.
