European Union (EU)*  :  Amendment to the Implementing Regulation Imposing a Definitive Anti-dumping Duty on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 123/2012 of 15 February 2012, the Council of the EU has published amendment to the implementing regulation imposing a definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China. DETAILS

2.In February 2012, the European Commission initiated ex-officio a partial interim review of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the Mainland of China as extended to imports of hand pallet trucks and their essential parts consigned from Thailand, whether declared as originating in Thailand or not, after it had noticed a change in the competition landscape in the Union market and considered that the circumstances on the basis of which the existing anti-dumping measures were established to have undergone lasting changes.

3.Following the partial interim review, Implementing Regulation (EU) No 1008/2011 imposing a definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China is amended to the effect that the applicable rate of anti-dumping duty would become 70.8% of the net, free-at-Union-frontier price before duty (including the individual duty rate for one company at 70.8%).

4.The amending implementing regulation shall enter into force on 25 April 2013.

BACKGROUND

5.Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China was initially imposed with effect from 22 July 2005 for five years. Consequent to a circumvention investigation, the anti-dumping duty has been extended with effect from 17 June 2009 to imports of hand pallet trucks and their essential parts consigned from Thailand, whether declared as originating in Thailand or not. Following an expiry review investigation initiated in 2010, the definitive anti-dumping duty has been maintained with effect from 14 October 2011 for another five years.
