European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Silicon Originating in the Mainland of China to Imports of Silicon Consigned from Taiwan, whether Declared as Originating in Taiwan or not

Further to the Commercial Information Circular No. 521/2012 of 6 July 2012, the Council of the EU (the Council) has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of silicon originating in the Mainland of China to imports of silicon consigned from Taiwan, whether declared as originating in Taiwan or not. DETAILS

2.The European Commission (the Commission) published on 6 July 2012 a regulation to initiate an investigation of the possible circumvention of anti-dumping measures imposed on imports of silicon originating in the Mainland of China. The regulation also made imports of silicon consigned from Taiwan, whether declared as originating in Taiwan or not, subject to registration.

3.Following the circumvention investigation, the Council has decided that, with effect from 6 April 2013, the definitive anti-dumping duty imposed on imports of silicon currently falling within CN code 2804 69 00 and originating in the Mainland of China be extended to imports of silicon consigned from Taiwan, whether declared as originating in Taiwan or not, currently falling within CN code ex 2804 69 00 (TARIC code 2804 69 00 20).

4.The Commission may authorise by decision the exemption of imports from companies which do not circumvent the anti-dumping measures from the anti-dumping duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. 5.With the extension of the anti-dumping duty, the registration of imports established in accordance with the regulation published on 6 July 2012 will also be discontinued.

BACKGROUND

6.Definitive anti-dumping duty on silicon originating in the Mainland of China was first imposed from 17 December 1997. Subsequent to an expiry review conducted in 2004, the duty was revised and maintained for five years.

7.Consequent to a circumvention investigation, the definitive anti-dumping duty on imports of silicon originating in the Mainland of China was extended to imports of the same products consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not, with effect from 20 January 2007.

8.As a result of an expiry review and an interim review initiated on 4 March 2009, the definitive anti-dumping duty imposed on imports of silicon originating in the Mainland of China, as extended to imports of silicon consigned from the Republic of Korea, has been maintained for another five years with effect from 30 May 2010. The current duty rate in force is 19% of the net, free-at-Union-frontier price before duty (except for one company whose individual duty rate is 16.3%).
