European Union (EU) * : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Certain Stainless Steel Fasteners and Parts Thereof Originating in the Mainland of China to Imports of the Same Products Consigned from the Philippines, whether Declared as Originating in the Philippines or not, and Termination of the Investigation of Possible Circumvention of the Anti-dumping Measures by Imports of the Same Products Consigned from Malaysia and Thailand, whether Declared as Originating in Malaysia and Thailand or not

Further to the Commercial Information Circular No. 458/2012 of 14 June 2012, the Council of the EU has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of certain stainless steel fasteners and parts thereof originating in the Mainland of China to imports of the same products consigned from the Philippines, whether declared as originating in the Philippines or not, and terminating the investigation concerning the possible circumvention of the anti-dumping measures by imports of the same products consigned from Malaysia and Thailand, whether declared as originating in Malaysia and Thailand or not. DETAILS

2.The European Commission (the Commission) published on 14 June 2012 a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain stainless steel fasteners and parts thereof originating in the Mainland of China. The regulation also made imports of the same products consigned from Malaysia, Thailand and the Philippines, whether declared as originating in Malaysia, Thailand and the Philippines or not, subject to registration.

3.Based on the findings of the circumvention investigation, the Council has decided that with effect from 13 March 2013, the definitive anti-dumping duty imposed on imports of certain stainless steel fasteners and parts thereof originating in the Mainland of China, falling within CN codes ex 7318 12 10, ex 7318 14 10, ex 7318 15 30, ex 7318 15 51, ex 7318 15 61 and ex 7318 15 70 (TARIC codes 7318 12 10 11, 7318 12 10 91, 7318 14 10 11, 7318 14 10 91, 7318 15 30 11, 7318 15 30 61, 7318 15 30 81, 7318 15 51 11, 7318 15 51 61, 7318 15 51 81, 7318 15 61 11, 7318 15 61 61, 7318 15 61 81, 7318 15 70 11, 7318 15 70 61 and 7318 15 70 81), shall be extended to imports of the same products consigned from the Philippines, whether declared as originating in the Philippines or not, with the exception of those produced by the companies listed in Article 1 of the implementing regulation.

4.The Commission may authorise by decision the exemption of imports from companies which do not circumvent the anti-dumping measures from the anti-dumping duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. 5.With the extension of the anti-dumping duty, the registration of imports of the concerned products consigned from the Philippines, whether declared as originating in the Philippines or not, will be discontinued with effect from 13 March 2013.

6.Meanwhile, in view of the findings regarding Malaysia and Thailand, the investigation concerning the possible circumvention of the anti-dumping measures by imports consigned from Malaysia and Thailand is terminated and the registration of such imports will also be discontinued.

BLACKGROUND

7.Definitive anti-dumping duties on certain stainless steel fasteners and parts thereof originating in, inter alia, the Mainland of China have been imposed since 20 November 2005. The current duty in force is 27.4% of the net, free-at-Union-frontier price before duty (except for two companies whose individual duty rates are 11.4% and 12.2% respectively).

8.As a result of an expiry review initiated on 19 November 2010, the definitive anti-dumping duty is maintained for further five years with effect from 8 January 2012.
