European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Certain Open Mesh Fabrics of Glass Fibres Originating in the Mainland of China to Imports of Certain Open Mesh Fabrics of Glass Fibres Consigned from India and Indonesia, whether Declared as Originated in India and Indonesia or not

Further to the Commercial Information Circular No. 274/2013 of 10 April 2013, the Council of the EU has published an implementing regulation to extend the definitive anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China to imports of certain open mesh fabrics of glass fibres consigned from India and Indonesia, whether declared as originating in India and Indonesia or not. DETAILS

2.The European Commission (the Commission) published on 10 April 2013 a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China since August 2011. The regulation also made imports of certain open mesh fabrics of glass fibres consigned from India and Indonesia, whether declared as originating in India and Indonesia or not, subject to registration by the EU's customs authorities.

3.Following the circumvention investigation, the Council has adopted the implementing regulation to extend, with effect from 21 December 2013, the definitive anti-dumping duty imposed on imports of open mesh fabrics of glass fibres, of a cell size of more than 1.8 mm both in length and in width and weighing more than 35 g/m2 , excluding fibreglass discs, originating in the Mainland of China to imports of the same products consigned from India and Indonesia, whether declared as originating in India and Indonesia or not, currently falling within CN codes ex 7019 51 00 and ex 7019 59 00 (TARIC codes 7019 51 00 14, 7019 51 00 15, 7019 59 00 14 and 7019 59 00 15) with the exception of those produced by one exporting producer in India, namely, Montex Glass Fibre Industries Pvt.Ltd.

4.The implementing regulation also specifies that the extended duty will be collected on imports consigned from India and Indonesia, whether declared as originating in India and Indonesia or not, registered in accordance with, inter alia, the above-mentioned Commission's regulation of April 2013.

5.Imports from companies which do not circumvent the anti-dumping measures imposed in August 2011 may be exempted from the duty extended by the implementing regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. 6.With the extension of the anti-dumping duty, the registration of imports established in accordance with the Commission's regulation of April 2013 will be discontinued.

BACKGROUND

7.Definitive anti-dumping duties on certain open mesh fabrics of glass fibres originating in the Mainland of China have been imposed since 10 August 2011. The current duty in force is 62.9% of the net, free-at-Union-frontier price, before duty (except for a number of companies whose individual duty rates range from 48.4% to 62.9%). Consequent to two separate circumvention investigations, the definitive anti-dumping duties have been extended to imports of certain open mesh fabrics of glass fibres consigned from Malaysia (with effect from 25 July 2012), regardless of whether they are declared as originating in Malaysia or not, and from Taiwan and Thailand (with effect from 17 January 2013), regardless of whether they are declared as originating in Taiwan and Thailand or not.

8.Separately, the Commission has initiated on 18 December 2013 an investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain open mesh fabrics of glass fibres originating in the Mainland of China by imports of certain slightly modified open mesh fabrics of glass fibres originating in the Mainland of China.
