European Union (EU)* : Extension of the Definitive Anti-dumping Measures Imposed on Imports of Certain Molybdenum Wires Originating in the Mainland of China to Imports of the Same Products Consigned from Malaysia, whether Declared as Originating in Malaysia or not, and Termination of the Investigation of the Possible Circumvention of the Anti-dumping Measures on the Same Products in respect of Imports Consigned from Switzerland

Further to the Commercial Information Circular No. 289/2011 of 18 May 2011, the Council of the EU has published a regulation to extend the definitive anti-dumping measures imposed on imports of certain molybdenum wires originating in the Mainland of China to imports of the same products consigned from Malaysia, whether declared as originating in Malaysia or not, and terminating the investigation concerning the possible circumvention of the anti-dumping measures in respect of imports consigned from Switzerland. DETAILS

2.The European Commission (the Commission) published on 18 May 2011 a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on certain molybdenum wires originating in the Mainland of China by imports of the same products consigned from Malaysia and Switzerland, whether declared as originating in Malaysia and Switzerland or not. The regulation also required imports of the products concerned consigned from Malaysia and Switzerland to be subject to registration.

3.Based on the findings of the circumvention investigation, the Council has decided that with effect from 13 January 2012, the definitive anti-dumping duty imposed on imports of certain molybdenum wires originating in the Mainland of China, falling within CN code ex 8102 96 00 (TARIC code 8102 96 00 11) shall be extended to imports of the same products consigned from Malaysia, whether declared as originating in Malaysia or not.

4.The Commission may authorise by decision the exemption of imports which do not circumvent the anti-dumping measures from the anti-dumping duty extended by this regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. 5.With the extension of the anti-dumping duty, the registration requirement of imports of the products concerned consigned from Malaysia, whether declared as originating in Malaysia or not, is discontinued with effect from 13 January 2012.

6.Meanwhile, in view of the findings regarding Switzerland, the investigation concerning the possible circumvention of anti-dumping measures by imports of the same products consigned from Switzerland is terminated and the registration of imports of the same products consigned from Switzerland is also discontinued.

BACKGROUND

7.Definitive anti-dumping duties on certain molybdenum wires originating in the Mainland of China have been imposed since 17 June 2010. The current duty in force is 64.3% of the net, free-at-Union-frontier price before duty.
