European Union (EU)* : Initiation of an Investigation Concerning the Possible Circumvention of Anti-dumping Measures Imposed on Imports of Certain Plastic Sacks and Bags Originating in the Mainland of China by Imports of Such Products Channelled via a Chinese Company Subject to a Lower Duty Rate, and Making Such Imports Subject to Registration
Further to the Commercial Information Circular No. 388/2006 of 29 September 2006, the European Commission (the Commission) has published a regulation to initiate an investigation concerning the possible circumvention of anti-dumping measures imposed on certain plastic sacks and bags originating in the Mainland of China by imports of such products channelled via a Chinese company, namely Xiamen Xingxia Polymers Co., Ltd., subject to a lower duty rate. The regulation also requires imports of the product concerned declared as being manufactured by the above company to be subject to registration. (b) Product Coverage | : | Plastic sacks and bags, containing at least 20 % by weight of polyethylene and of sheeting of a thickness not exceeding 100 micrometers (μm), currently falling within CN codes ex 3923 21 00, ex 3923 29 10 and ex 3923 29 90 (TARIC codes 3923 21 00 20, 3923 29 10 20, and 3923 29 90 20). |

In order to obtain necessary information for the investigation, the Commission will send questionnaires to Xiamen Xingxia Polymers Co., Ltd as well as to other companies allegedly have their products exported to the Union through Xiamen Xingxia Polymers Co., Ltd. The authorities of the Mainland of China will be notified of the initiation of the investigation. Interested parties should request a copy of the questionnaire from the Commission within 15 days from 20 August 2010. All interested parties may make their views known in writing (including submitting questionnaire replies) and apply to be heard by the Commission within 37 days from 20 August 2010, unless otherwise specified. (d) Registration of Imports | : |
With effect from 21 August 2010, imports of the product concerned, namely plastic sacks and bags declared as being manufactured by Xiamen Xingxia Polymers Co., Ltd and declared under TARIC additional code A981, are subject to registration by the EU's customs authorities. The registration shall expire nine months from 21 August 2010. Should the investigation, which will be concluded within nine months from 20 August 2010, result in findings of circumvention, anti-dumping duties of an appropriate amount can be levied retroactively from the date of registration of such imports. |
BACKGROUND

Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The current duty in force is 28.8% of the net, free-at-Union-frontier price before duty (except for a number of companies where the individual duty rates range from 4.3% to 12.8%) (details can be found in Commercial Information Circulars No. 388/2006 of 29 September 2006, No. 180/2008 of 20 March 2008 and No. 133/2009 of 12 March 2009).
