European Union (EU)* : Termination of the Anti-dumping Proceeding Concerning Imports of Certain Hot-dipped Metallic-coated Iron or Steel Flat-rolled Products Originating in the Mainland of China

Further to Commercial Information Circular No. 510/2007 of 14 December 2007, the European Commission (the Commission) published a decision to terminate the anti-dumping proceeding concerning imports of certain hot-dipped metallic-coated iron or steel flat-rolled products originating in the Mainland of China. DETAILS

  1. The Commission disclosed in an Interim Report on 15 September 2008 that the investigation established provisionally the existence of dumping but not that of material injury and underlined the need to investigate further the aspect of possible threat of injury. It was considered appropriate not to impose any provisional anti-dumping duty but to continue the investigation. Subsequently, the complainant formally withdrew its complaint by a letter on 11 December 2008. According to the complainant, the withdrawal was prompted by the recent market turbulence and it did not want to pursue the case on volume-based threat of injury based on analysis of historic data that no longer reflect the current market situation. The complainant requested the Commission to actively monitor imports of the product concerned. The Commission considered it appropriate to monitor, in the near future, imports into the Community of the product concerned originating in the Mainland of China. The monitoring period should not exceed 24 months from the publication of the termination of the present proceeding (i.e. 7 February 2009). The Commission does not rule out the opening of a new investigation concerning the same product if and when there is injurious dumping. The Commission therefore concludes that the anti-dumping proceeding should be terminated without the imposition of anti-dumping measures.  

BACKGROUND

  1. The Commission initiated the proceeding on 14 December 2007 on the basis of a complaint lodged by EUROFER representing more than 25% of the total Community production of certain hot-dipped metallic-coated iron or steel flat-rolled products. It was alleged that imports of the product concerned originating in the Mainland of China were being dumped, thereby causing material injury to the Community industry.
