European Union (EU)* : Anti-dumping Measures on Imports of Ironing Boards Originating in the Mainland of China and Partial Reopening of the Anti-dumping Investigation Concerning Imports of Ironing Boards Originating in, inter alia, the Mainland of China

Further to the Commercial Information Circular No. 498/2009 of 2 October 2009, the European Commission (the Commission) has published a notice on the anti-dumping measure on imports of ironing boards concerning one exporting producer in the Mainland of China, Foshan Shunde Yongjian Housewares and Hardware Co. Ltd. (Foshan), and the partial reopening of the anti-dumping investigation on imports of ironing boards originating in the Mainland of China. The notice can be accessed through the following link :

Anti-dumping measure on Foshan Shunde Yongjian Housewares and Hardware Co. Ltd.

  1. The Commission announced that the Court of Justice of the European Communities, by its judgement of 1 October 2009, annulled the Council Regulation imposing definitive anti-dumping measures on imports of ironing boards originating in the Mainland of China insofar as it concerns imports manufactured by Foshan Shunde Yongjian Housewares and Hardware Co. Ltd. (Foshan). As a consequence of the judgement, imports into the European Union of ironing boards manufactured by Foshan are no longer subject to the anti-dumping measures. The definitive anti-dumping duties paid by and provisional duties definitively collected from Foshan should be repaid or remitted.

Partial re-opening of the anti-dumping investigation

Grounds for the investigation

  1. The courts of the European Union recognizes that the annulment of part of the Council Regulation on the definitive anti-dumping measure does not imply the annulment of the entire procedure on the adoption of the Regulation in question. Accordingly, the European Union's institutions, in complying with the judgement of the courts, have the possibility to remedy the aspects of the contested Regulation which led to its annulment, while leaving unchanged the uncontested parts which are not affected by the judgement. The Commission thus decided to reopen the anti-dumping investigation concerning imports of ironing boards originating in the Mainland of China. The reopening is limited in scope to the implementation of the above-mentioned judgement as far as Foshan is concerned.

  2. Salient points of the investigation are set out below-
(a) Date of Publication of the Notice of Initiation : 18 December 2009
(b) Product Coverage :

Ironing boards, whether or not free-standing, with or without a steam soaking and/or heating top and/or blowing top, including sleeve boards, and essential parts thereof, i.e. the legs, the top and the iron rest, currently falling within CN codes ex 3924 90 90, ex 4421 90 98, ex 7323 93 90, ex 7323 99 91, ex 7323 99 99, ex 8516 79 70 and ex 8516 90 00.

(c) Procedures :

All interested parties, if their representations are to be taken into account, must make themselves known by contacting the Commission, present their views and submit any information within 20 days from 18 December 2009, unless otherwise specified. They may also apply to be heard by the Commission within 20 days from 18 December 2009.

BACKGROUND

  1. Definitive anti-dumping duty on ironing boards originating in, inter alia, the Mainland of China has been imposed since 27 April 2007. The current duty in force is 38.1% of the net, free-at-Community-frontier price before duty (except for 5 companies whose individual duty rates range from 0% to 36.5%). The duty rate for Foshan was 18.1%.
