European Union (EU)* : Initiation of an Anti-dumping Proceeding Concerning Imports of Ironing Boards limited to one Chinese Exporting Producer and a Review of the Anti-dumping Measures on Imports of Ironing Boards Originating in the Mainland of China

Further to the Commercial Information Circular No. 186/2007 of 26 April 2007, the European Commission (the Commission) has published a notice to initiate an anti-dumping proceeding on imports of ironing boards limited to one Chinese exporting producer, Since Hardware (Guangzhou) Co. Ltd (Since Hardware), and a review of the anti-dumping measures on ironing boards originating in the Mainland of China. The notice can be accessed through the following link :

DETAILS

Anti-dumping proceeding concerning Since Hardware

  1. Salient points of the anti-dumping proceeding are set out below-
(a) Date of Publication of 
the Notice of Initiation

(b) Product Coverage : Ironing boards, whether or not free-standing, with or without a steam soaking and/or heating top and/or blowing top, including sleeve boards, and essential parts thereof, i.e. the legs, the top and the iron rest, currently falling within CN codes ex 3924 90 90, ex 4421 90 98, ex 7323 93 90, ex 7323 99 91, ex 7323 99 99, ex 8516 79 70 and ex 8516 90 00 (these CN codes are given only for information).
(c) Procedures :

In view of the apparent large number of Community producers involved in the proceeding, the Commission may apply sampling. To enable the Commission to decide whether sampling is necessary and, if so, to select a sample, all Community producers should make themselves known to the Commission and provide information requested in paragraph 5.1 (a) (i) of the notice in question, including contact details, turnover, activities of their company/related companies, production, and indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation. Such information should reach the Commission within 15 days from 2 October 2009. All interested parties wishing to submit any relevant information regarding the selection of the sample must do so within 21 days from 2 October 2009. The Commission intends to make the final selection of the samples after having consulted the parties concerned that have expressed their willingness to be included in the sample.

In order to obtain necessary information for the investigation, the Commission will send questionnaires to, among others, the sampled Community industry, any association of producers in the Community and to Since Hardware.

The Commission will also send market economy status claim form to Since Hardware. Duly completed claims for market economy status and/or for individual treatment must reach the Commission within 15 days from 2 October 2009.

If sampling is applied, sampled parties must reply to the questionnaires within 37 days from the date of the notification of their inclusion in the sample.

All interested parties should request a questionnaire or other claim forms within 10 days from 2 October 2009.

All interested parties, if their representations are to be taken into account, must make themselves known by contacting the Commission, present their views and submit questionnaire replies or any other information within 40 days from 2 October 2009, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 2 October 2009.

It is envisaged to choose the United States of America as a market economy country for the purpose of establishing normal value in respect of the Mainland of China. Interested parties are invited to comment on the appropriateness of this choice within 10 days from 2 October 2009.

(d) Investigation Schedule : Provisional measures may be imposed no later than 9 months from 2 October 2009. Investigation will be concluded within 15 months from 2 October 2009.

Review of the existing anti-dumping measures

  1. The Commission considers that the continued imposition of the existing anti-dumping measures on Since Hardware (i.e. a duty rate of 0%) is no longer appropriate and should be amended accordingly. A review should therefore be initiated in order to allow any amendment necessary.

BACKGROUND

  1. Definitive anti-dumping duty on ironing boards originating in, inter alia, the Mainland of China has been imposed since 27 April 2007. The current duty in force is 38.1% of the net, free-at-Community-frontier price before duty (except for 5 companies whose individual duty rates range from 0% to 36.5%). The duty rate for Since Hardware was 0%.
