European Union (EU)* : Maintaining the Anti-dumping Duties on Imports of Certain Finished Polyester Filament Fabric Originating in the Mainland of China following a Partial Interim Review

Further to Commercial Information Circular No. 341/2008 of 27 June 2008, the Council of the EU (the Council) has published a regulation to maintain the anti-dumping measures imposed on imports of certain finished polyester filament fabric (PFF) originating in the Mainland of China pursuant to a partial interim review. The regulation can be accessed through the following link:

DETAILS

  1. The review was initiated at the request of Hüpeden GmbH & Co. KG (the applicant), an importer from Germany, and was limited to the examination of the product scope. The applicant alleged that the product it imports was only used to produce a special adhesives tape for insulation of cables within the wiring harness of engines, mainly engines of cars (hereinafter "tape" grade) and that the technical and chemical characteristics of this "tape" grade are different from other types of PFF. The review investigation revealed that "tape" grade and other types of PFF shared the same basic physical, technical and chemical characteristics. Moreover, it could not be demonstrated that "tape" grade had one single possible use and that "tape" grade and other types of PFF were not interchangeable. Thus, the Council concluded that "tape" grade and other types of PFF should be considered as one single product and that the partial interim review should be terminated without amending the anti-dumping measures in force.

Background

  1. Definitive anti-dumping duty on imports of certain finished polyester filament fabrics originating in the Mainland of China had been imposed since 17 September 2005. Subsequent to a re-investigation, the rate of duty was revised to 74.8% of the net free-at-Community-frontier price before duty (except for 46 companies with individual duty rates ranging from 14.1% to 74.8%) with effect from 22 September 2007.
