European Union (EU)* : Result of Expiry Review of the Anti-dumping Measures on Imports of Certain Tube and Pipe Fittings, of Iron or Steel Originating in, inter alia, the Mainland of China and Those Consigned from Chinese Taipei, Whether Declared as Originating in Chinese Taipei or Not

Further to the Commercial Information Circular No. 313/2008 of 5 June 2008, the Council of the EU has published a regulation announcing the decision to maintain the definitive anti-dumping duty imposed on imports of certain tube or pipe fittings of iron or steel originating in, inter alia, the Mainland of China and those consigned from Chinese Taipei, whether declared as originating in Chinese Taipei or not, consequent to an expiry review. DETAILS

  1. Salient points are set out below-

(a) Product :

Tube and pipe fittings (other than cast fittings, flanges and threaded fittings), of iron or steel (not including stainless steel), with a greatest external diameter not exceeding 609.6 mm, of a kind used for butt-welding or other purposes, currently falling within CN codes ex 7307 93 11, ex 7307 93 19, ex 7307 99 30 and ex 7307 99 90 (TARIC codes 7307 93 11 91, 7307 93 11 93, 7307 93 11 94, 7307 93 11 95, 7307 93 11 99, 7307 93 19 91, 7307 93 19 93, 7307 93 19 94, 7307 93 19 95, 7307 93 19 99, 7307 99 30 92, 7307 99 30 93, 7307 99 30 94, 7307 99 30 95, 7307 99 30 98, 7307 99 90 92, 7307 99 90 93, 7307 99 90 94, 7307 99 90 95, 7307 99 90 98).

(b) Rate of Duty :

58.6% of the net, free-at-Community-frontier price, before duty.

(c) Effective Date : 5 September 2009
(d) Duration : 5 years

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain tube or pipe fittings of iron or steel originating in, inter alia, the Mainland of China was first imposed on 4 April 1996 at a rate of 58.6% of the net, free-at-Community-frontier price before duty. Consequent to an expiry review, the duty has been extended for a five-year period since 7 June 2003. 

  2. As a consequence of separate circumvention investigations, the definitive anti-dumping duty imposed on imports of the products concerned extended to imports of the same products consigned from (i) Chinese Taipei, (ii) Indonesia or Sri Lanka, and (iii) the Philippines, whether declared as originating in Chinese Taipei, Indonesia, Sri Lanka or the Philippines or not.

  3. On the basis of a request lodged by the Defence Committee of the Steel Butt-Welding Fittings Industry of the EU, representing over 25% of the Community production of certain tube or pipe of iron or steel, the Commission initiated the expiry review on 5 June 2008. As a result of the expiry review, the definitive anti-dumping duty extended to the imports of the same products consigned from Chinese Taipei, Indonesia, Sri Lanka and the Philippines is also maintained.
